TERMS & CONDITIONS

1. RENTAL CONDITIONS

1.1 The Renter must be at least 23 years and must be in possession of a valid driver’s license for at least 3 years.

1.2 The Renter acknowledges and agrees that the vehicle is property of Samurai Curaçao Car Rental B.V. and is received in good mechanical condition.

1.3 The Renter must return the vehicle together with all accessories in the same conditions to Samurai Curaçao Car Rental B.V. Any changes and additions to the vehicle are prohibited.

1.4 The rental vehicle must be returned at the location; on the day; and time stated on the rental agreement. For each additional hour the vehicle has not been returned, a fee of 15 USD will be charged. After 4 hours, the daily rental rate will be charged.

1.5 The rental vehicle must be rented for a minimum period of 3 days.

2. USE & MAINTENANCE

2.1 The Renter agrees:

that the rented vehicle shall not be used to carry passengers or property for hire
that the rented vehicle shall not be used to carry passengers in excess of the capacity thereof
not to use the vehicle for any race or competition
not to use the vehicle for any illegal purpose
not to operate the vehicle in a negligent manner
to comply with traffic regulations applicable in Curaçao
to not allow animals or pets in the vehicle
not to use the vehicle on unpaved roads
not to use the vehicle to propel or for towing
if not, a fee of 200 USD will be charged

2.2 Only the individual(s) authorized as driver(s) in the rental agreement is (are) allowed to drive the vehicle. The Renter is fully liable for all damages that Samurai Curaçao Car Rental B.V. may incur because of negligence of this obligation.

2.3 The Renter is responsible to ensure that neither passengers nor any occupants smoke or vape inside the vehicle; if not, a fee of 200 USD will be charged.

2.4 The Renter is responsible for returning the vehicle clean. If not, a fee of 35 USD will be charged.

2.5 The Renter is responsible returning the vehicle with the same amount of fuel as it was received. If this amount is less, the Renter will be charged the difference at a rate of 30 USD for every quart tank, this excluding tax. Charges for fuel will not be refunded. The Renter is also responsible for using the right kind of fuel.

2.6 The Renter will take every warning signal from the vehicle seriously and will not use the vehicle in case it is damaged or unsafe to drive.

3. ACCIDENT

3.1 In case of an accident or event, the Renter must always:

leave the car standing exactly where the accident happened, even if this is in the middle of the road
inform Curaçao Road Service (005999) 199
warn the local police only in case of any injuries
inform Samurai Curaçao Car Rental B.V. by telephone
volunteer to Samurai Curaçao Car Rental B.V. or his insurer all information and document relating to the event
submit a completed and signed claim form to Samurai Curaçao Car Rental B.V. within 48 hours
refrain from accepting blame in any way
make sure never to leave the vehicle behind without having properly protected it against any (more) damage or the risk of loss
cooperate fully with Samurai Curaçao Car Rental B.V. or any individuals authorized by Samurai Curaçao Car Rental B.V., to enable Samurai Curaçao Car Rental B.V., to collect damages from any third parties or to fend off any third-party claims.

4. REPAIRS & TECHNICAL ASSISTANCE

4.1 In case a mechanical or technical event occurs the Renter must always:

call 24/7 Road Service at (005999) 9247 for assistance
inform Samurai Curaçao Car Rental B.V. by telephone.

4.2 The Renter is not permitted to carry out repairs.

4.3 Samurai Curaçao Car Rental B.V. is never liable for any (consequential) damage due to improper functioning of the vehicle.

5. DAMAGE AND/OR THEFT

5.1 Samurai Curaçao Car Rental B.V. is not liable for loss or theft of property from the vehicle.

5.2 Samurai Curaçao Car Rental B.V. shall not be liable for disappearance or damage to any property left, stored, or transported by renter or other persons, in or on the vehicle, either before or after it has been returned to Samurai Curaçao Car Rental B.V.

5.3 he Renter hereby agrees that he shall fully indemnify Samurai Curaçao Car Rental B.V. for all loss of or damage to the vehicle or equipment during the term of his agreement whether caused by collision, fire, flood, vandalism, theft, or any other cause.

5.4 The Renter hereby agrees that Samurai Curaçao Car Rental B.V. is not responsible for any personal / belongings / injuries / lost.

5.5 For loss of keys and/or damage to remote controls, the Renter will be charged an amount of 225 USD.

6. INSURANCE

6.1 It is expressly understood and agreed that the daily rate only includes third party insurance with an additional insurance liability of 200USD together with Full Liability of the rented vehicle in case of fault, in accordance with an automobile liability insurance policy customary in Curaçao.

7. APPLICABLE LAW

7.1 All agreements between Samurai Curaçao Car Rental B.V., the Renter and the present general terms and conditions will always be governed by Dutch Antillean law. All disputes resulting from and are agreed in these terms and conditions and those resulting thereafter will be judged at the ‘Gerecht in Eerste Aanleg van de Nederlandse Antillen’, seated in Curaçao.

7.2 The Renter agrees to pay any fines or financial consequences of measures imposed by the government with respect to using the vehicle; unless such costs are related to a defect which was already present at the point the rental agreement was signed.

7.3 In the event of administrative, civil, or those of paying the rental fee, until the moment at which the vehicle is in possession of Samurai Curaçao Car Rental B.V.

7.4 Samurai Curaçao Car Rental B.V. is entitled to terminate the rental agreement if Samurai Curaçao Car Rental B.V. becomes aware of circumstances during the rental period of such a nature that Samurai Curaçao Car Rental B.V. would not have concluded the rental agreement if he had known about it.
